§ 1 Scope, provider

(1) These Terms govern all contracts that a consumer or trader concludes with Karoxa LLC-FZ ("provider") through the online shop at https://noreestore.com.

(2) A consumer within the meaning of these Terms is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB).

(3) Conflicting terms of the customer shall not become part of the contract unless the provider has expressly agreed in writing.

§ 2 Conclusion of contract

(1) The presentation of products in the online shop does not constitute a legally binding offer but an invitation to submit an order.

(2) By clicking the "Order with obligation to pay" button the customer submits a binding offer to purchase the goods in the cart.

(3) The provider acknowledges receipt of the order without undue delay by email. This acknowledgement does not yet constitute acceptance of the offer. The contract is formed when the provider sends an express order confirmation or dispatches the goods.

(4) The provider stores the contract text. The order data is sent to the customer by email and is available in the customer account.

(5) Contract languages are German and English.

§ 3 Prices and shipping

(1) All prices are final prices stated in Euro (EUR) and include statutory VAT unless otherwise indicated.

(2) Shipping costs are disclosed separately during checkout before the order is placed and are payable by the customer.

(3) For shipments with a goods value above €150, import VAT and customs duties may apply additionally. These are collected by the carrier on delivery unless stated otherwise. See Shipping & payment.

§ 4 Payment

The payment methods offered during checkout are binding. The purchase price is due upon conclusion of the contract. Card, PayPal and SEPA payments are processed by our payment service provider Stripe.

§ 5 Delivery, retention of title

(1) Delivery is made to the address provided by the customer. Expected delivery times are stated during checkout.

(2) The goods remain the property of the provider until full payment.

(3) Passing of risk: for consumers, the risk of accidental loss only passes when the goods are handed over to the customer (§ 475 (2) BGB).

§ 6 Right of withdrawal

Consumers have a 14-day right of withdrawal. Details are set out in our Withdrawal Policy, which also includes the model withdrawal form.

§ 7 Warranty for defects

The statutory warranty rules under §§ 434 et seq. BGB apply. For consumer contracts the limitation period is two years from delivery.

§ 8 Liability

(1) The provider is liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act, and within the scope of any guarantee given.

(2) For slight negligence the provider is liable only for breach of essential contractual duties ("cardinal duties"); liability is then limited to typical, foreseeable damage. Liability for slight negligence is otherwise excluded.

§ 9 Dispute resolution

The European Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).

§ 10 Governing law, jurisdiction

(1) German law applies, excluding the UN Convention on the International Sale of Goods. For consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection of mandatory provisions of the law of the country of their habitual residence (Art. 6 (2) Rome I).

(2) The exclusive place of jurisdiction for all disputes arising from this contract with merchants, legal entities under public law or special funds under public law is the registered seat of the provider; for consumers, statutory places of jurisdiction apply.

§ 11 Final provisions

If any provision of these Terms is or becomes invalid, the validity of the remaining provisions shall not be affected.
